Terms of Use

These Terms of Use (the “Terms”), the Privacy Policy, the Web Privacy Policy, and the Online Purchase Terms and Conditions (together, the “Agreement”) constitute the entire agreement between Water-Protec Distribution Inc. (“Water-Protec”) and the user regarding access to and use of the website water-protec.com (the “Site”) and all of its content. The Agreement, of indefinite duration, takes effect upon the user’s first access to the Site.

The user acknowledges understanding and accepting all terms and conditions set out in the Agreement. The Terms may be modified by Water-Protec at its sole discretion and without notice. The user is encouraged to review them periodically to stay informed of any changes.

Accessing or using the Site constitutes acceptance of these Terms. The user consents to all communications with Water-Protec being conducted electronically.

At all times, the user is encouraged to verify whether they are browsing the Site or a third-party site by confirming that the URL displayed at the top of their screen corresponds to water-protec.com.

General Information

The content of the Site is provided for informational purposes only and may not under any circumstances constitute sufficient information on which the user may base any transactions or decisions of any nature.

The information presented on the Site cannot replace the advice of a qualified professional. Water-Protec makes no guarantee as to the availability of the Site and reserves the right to discontinue, modify, suspend, or remove it, in whole or in part, at any time, at its sole discretion and without notice.

Water-Protec also reserves the right to deny any user access to the Site without notice and without having to provide justification. Water-Protec may monitor the use of and access to the Site. The Site is accessible “as is” and may not be modified by the user. Use of the Site is at the user’s own risk.

Prohibited Use of the Site

The user agrees not to, including but not limited to:

• include or copy the Site or any part of the Site into another website they create or distribute;
• use the Site in a way that damages, disables, or compromises its security, or the security of any hosting provider;
• transmit computer viruses, Trojan horses, or any malicious software capable of disrupting or destroying the Site’s infrastructure or placing an unreasonable burden on it;

• use the Site in a manner that is unlawful in the user’s jurisdiction;
• post on the Site content that is indecent, harmful, intimidating, vexatious, defamatory, fraudulent, misleading, threatening, vulgar, pornographic, or explicitly sexual;
• post on the Site content that would encourage other users to post prohibited content;
• disclose the personal information or images of any individual without their consent;
• collect personal information from users of the Site, including email addresses, without their consent;
• use the Site for commercial purposes other than those directly related to a transaction with Water-Protec, including soliciting other users for any reason whatsoever;
• create a mirror image of the Site.

Copyright

All names, logos, and designs related to Water-Protec displayed on the Site constitute trademarks, whether registered or not, and are the exclusive property of Water-Protec.

The Site and all its content are protected by copyright. All content appearing on the Site (including titles, logos, icons, graphics, designs, and other elements) is the exclusive property of Water-Protec or its suppliers and is protected by Canadian and international copyright laws. The user may not, without the written consent of Water-Protec, reproduce, copy, publish, communicate, or use in any way the materials, information, or trademarks displayed on the Site.

The user is granted a non-exclusive, non-transferable, non-sublicensable, revocable, and limited licence to copy, download, display on their computer, print, and use the content of the Site for informational purposes only and solely for their personal use.

Products

Water-Protec aims to provide the most accurate and complete information regarding the products it sells. However, Water-Protec does not guarantee that product descriptions or any other content on the Site are accurate, complete, reliable, current, or error-free. No information on the Site may be interpreted as an endorsement of any product by Water-Protec or as implying any association between Water-Protec and any product. To the extent permitted by law, Water-Protec shall not be held liable for a user’s use of such products for the purpose of preventing, diagnosing, or treating any medical condition.

Price Policy

Product prices and availability are subject to change without notice. Although Water-Protec makes every effort to avoid pricing errors on the Site, typographical errors may occasionally occur. Water-Protec reserves the right to make any necessary corrections and shall not be held liable for such errors. All prices displayed on the Site are in Canadian dollars and exclude shipping fees and applicable taxes (GST, QST, PST, and/or HST), unless otherwise indicated.

Privacy

Water-Protec collects and uses personal information submitted by the user through the Site in accordance with its Privacy Policy and Web Privacy Policy, both of which form an integral part of these Terms of Use. The user understands that such information is used solely for the purposes described in those policies and in compliance with the requirements of Law 25.

The use of cookies and browsing data collected on the Site is governed by the Web Privacy Policy, available on the Site. Water-Protec may use the user’s contact information and any other information collected through the Site in accordance with its privacy policies.

Water-Protec makes no representation and offers no guarantee regarding the confidentiality of any information transmitted over the Internet, by email, or by any other electronic means. The user acknowledges that transmitting information over the Internet involves inherent risks.

Account and Password

The user acknowledges that it is their responsibility to maintain the confidentiality of their account information and password. The user is responsible for all activity on their account, whether or not they have expressly authorized it. The user is also responsible for maintaining the security of their account, including their account number, username, and password.

The user is responsible for the accuracy of information submitted through the Site and agrees that such information is truthful, current, and accurate. The user shall be liable for any loss, damage, or additional costs incurred by Water-Protec or any service provider as a result of false, erroneous, inaccurate, or incomplete information.

To the extent permitted by law, all responsibility related to password management rests with the user. Under no circumstances, including negligence or misconduct, shall Water-Protec be held liable for damages arising from the use of the user’s account.

Purchases

Purchases made through the Site are subject to the Online Purchase Terms and Conditions, which form an integral part of these Terms of Use.

Disclaimer

The Site and its content are provided “as is” and as available. Water-Protec makes no representation or warranty, express or implied, with respect to the operation of the Site, the information it contains, or the products and services offered on the Site. Subject to any applicable public order legislation and applicable laws, Water-Protec shall not be held liable and makes no warranty, including warranties of merchantability and/or fitness for a particular purpose.

Water-Protec makes no representation regarding the use, validity, accuracy, or reliability of the content on the Site, nor as to the results obtained from using such content. Although Water-Protec makes every effort to keep the Site free of errors, it accepts no responsibility for any errors that may be found. Water-Protec does not guarantee the absence of viruses or other harmful components on the Site, its servers, or in email communications originating from Water-Protec.

Water-Protec, its officers, employees, representatives, and agents shall not under any circumstances be liable for any damage directly or indirectly related to use of the Site, including loss of data or profit resulting from use of or inability to use the Site’s content. Water-Protec is not responsible for any damage or claim related to misuse of a product, abuse, product modification, poor product selection, or unlawful appropriation. To the fullest extent permitted by law, Water-Protec’s liability is limited to direct damages.

Applicable Law

The Agreement and the content of the Site are governed by the laws of Quebec and applicable federal laws. Any dispute arising from these Terms will be submitted to the competent courts in the judicial district of Longueuil, to the exclusion of any other court. Should any particular provision of these Terms of Use be found invalid by a competent court, such invalidity shall in no way affect the spirit or scope of these Terms, and all other provisions shall remain in full force and effect. The failure to exercise any right under these Terms of Use shall not in any case be construed as an express or implied waiver by Water-Protec of its future exercise of that right or any other right provided for in these Terms of Use.
